Well today was very annoying. Long story short my mother use to run a bakery business for 3 decades but she decided to go out of business 2 years ago. The rent, utility bills, baking materials and taxes were just too much nowadays, and it was time to call it quits and so she closed up and retired. Than 2 weeks ago she get's a letter from the State Board Labor Commission that she has a conference meeting because a former employee (let's call him Bob)  filed a lawsuit against her. Bob claims that she owns him unpaid wages for one year and it's a total of 8 grand and he want's her to pay him. I know for a fact that he's lying about everything, I have my reasons like :

1. Bob never complained to me that she owns him money. We use to be very good friends at one point, we talk about almost anything BUT my mom owning him money? He never brought that up what so ever...

2. Why did it took him a total of 2 year's to file that lawsuit against her? I just find it funny and suspicious that after 2 year and hearing stories about how he owns so many people money he decides to sue my mom for cash.

3. He also filed another lawsuit last October 2015 with my moms former Insurance company.  He claims that he suffered multiple injuries at our business but we know it's all lies because he switched the dates of his injury 3 times! We also provided evidence like photo and videos to the insurance lawyers of him running, tube sledding and working normally at his catering business and showing no signs of injury. To this day the case is still going and I hope in the end he pays dearly. To me if Bob is lying about his injuries than no doubt in my mind that he's lying to the Labor commission too.

4. He claims that he worked 8 hrs Monday to Sunday and did over 150 hrs of overtime which is 100% NOT TRUE! He was there just to learn and only stayed  3-4 hrs 5 days a week.

5. He claims it's a total of 380 regular hours, 150 overtime hrs and got paid 12.00 an hr. Bob also wanted my mom to pay him an additional 1,500 dollars for making him wait for one year........... I find that part of his claim very funny because its the exact same numbers as what his girlfriend did to another business 5 year's ago.....

   Anyways the conference meeting we had today only lasted 50 minutes, the case was settled and my mom ended up paying him, he wanted at least 1,700 and he'll settle with that. He wasn't there though at the meeting, he decided to be on a speaker phone far away from us ( coward).  My mom wasn't devastated or anything, it was actually the opposite, she was glad this was cleared up and she can move on with her life. She used some of her retirement money to pay the SOB .

 And of course just in case some of you are wondering why my mom didn't continue to fight this case??? Well it's because my mom made a huge mistake and it cost ed her that 1,700 dollars. You see my mom when she went out of business and retired she got rid of all of her old business documents and time cards she had at the bakery. Also she paid him under the table, which was a very stupid thing to do. If she continued on with the case than Bob would of most likely won the case and she would ended up paying 6, 7 maybe 8 grand to Bob, so it was not worth it.

 As for me....... It was very hard for me to stay quiet in the conference room.... you know hearing all the BS lies from Bob and hearing his voice trying to play the victim..... wow .... the old me would of gone to his apartment and pay him a nice visit....... But one way or the other I know that he's going to pay some day for what he has done, not just my mom but there's plenty of other people that he took advantage of. Any of you guys had issues with someone like that?

pebric : That's....I am sorry to hear about that. That's not a good friend. If he can do many lies and get away with it. Then he is a really bad person. Why did your mother pay that amount of money? She should had fight back. And really if you should go to his house and punch him...but knowing that he will call the cops on you and spread more lies. Its sad people like that can get away with so many things. I do hope he will get what is coming to him very soon because as a saying goes a liar doesn't go unpunished. And again I really an sorry this happened to you and your mother. :/

I'm sorry for what you have to deal with, buddy. Financial fraud is frivolous. Sorry you lost the case, friend. Reminds me of a manipulative woman from days' past. It happened last year, at Seneca's newnham campus. I was minding my own business, and this woman approached me, telling me about some ridiculous donation service that was sweeping the campus, telling the students that their donations could help starving African children. I wanted to ignore her, but that wouldn't be very nice, plus she was calling me out. I asked if anyone else was doing this; no one seemed interested, but she insisted it was a rousing success and I would be helping immensely. Due to the flattery, I complied to her absurd demands. We walked all around to search for a bank to give her a sizable amount of cash, but I'm thankful that we didn't find one, or I couldn't access my account. I just gave her 5 dollars and she left me alone. Later on, my mom asked for the cash back. I said I donated it to some nice woman supporting starving children, my mom believed it was a sham because no one else did a similar thing, and she just scammed me out of my money. Realizing this, I instantly became resentful. The moral is; don't trust everyone so willingly. Always look for the absolute truth before you decide on what the "right" choice is. People can take advantage of one's naivete. Defend what you own. Prioritize your assets; at once! 

Eniitan : Even if my mom continue the case and decided to fight it, she would most likely lose the case in the end. Where I live, the State Board Labor Commission have there'll own Set's of rules and regulations and one of the them is this..... if the employer (my mom) doesn't have any legal documents, signed contracts, or time cards of that specific employee who is suing, than the victory goes to the employee. The employee doesn't need any evidence at all to win the case, because if the employer doesn't have any solid documented evidence than the Labor Commission officer will take the employee's side. That is why it's extremely important to always..... ALWAYS add your employee's on the payroll of your business. That way if he attempts to take you to the labor commission, you have the legal documents to support and defend your case and my mom didn't have any of that. You see Eniitan my mom is old school, she's around her mid 70's and she's from a time where a hand shake is considered a legal agreement unlike today where you need actual written documents and contracts.

  Bob basically took advantage of my mom's kindness and it costed her money, but hey...... it could of been a lot worse since he originally was asking 8 grand but instead he settled with just 1,700.

 You are right I should go and punch him, beat him down. That's what everyone tells me, but there's two reasons why I don't do it and one of them is that he is capable of calling the cops on me and two he's in a second lawsuit with my mom (yes a SECOND LAWSUIT). He claims that he suffered multiple injuries at my moms bakery and wishes that her former insurance company pays for the damages. If I go hurt him now that would hurt the case. I'm not worried at all because I have good evidence against him like photos, videos unlike the Labor Commission case. I've been helping the lawyers out because I want to make sure he doesn't get away with what he's doing, he needs to be ruined.  He may of won the battle but he won't win the war.

pebric : That's really cruel of what that guy did. Such a lowlife. I hope he gets caught soon for doing something so terrible as that. This is a really sad thing. You shouldn't be going through something so bad as this. But you can never know. There are people out there willing to find cocky ways to damage a friends life. I am sorry to hear that and some people are scumbags and wait until much later to actually do something about it. As for your mother getting rid of her documentation,yes,in hindsight,that was pretty stupid. But she thought she was done with it and in her mind,she no longer needed it. If I was the judge or the arbitrator in this case,I would have thrown the case out. I mean,your lawyers showed video evidence of him being perfectly fine and in my mind that would have set doubt in my mind about the rest of his claims. If I was your mother,I would countersue for defamation and character assassination among other things.

In my world,not only would I let you punch him,I would have him chained up so he cannot defend himself and I would have him thrown in jail for wasting my time. But alas,it is not my world.

The only thing I can say is take away this lesson,always get documentation for anything.
