Seishiro Leonhart : Naw, it isn't acid. These are a type of ink cap mushrooms. When they grow and open up, their gills will start to turn brownish-back and start dripping. That black goo is actually their spores. These type are not exactly toxic. As a matter of fact, they are edible as long as it is before they turn black. They are sometimes used for cooking (medal of bravery to the first person to try it). But touching the stuff or the shrooms themselves will not really harm you. Might make you a little sick if your body had a reaction to it, but that would be the extent of it (assuming you aren't just eating a lot of it)

I agree with rcarter completely. Since that is an apartment, your landlord should be doing something about the mushroom since landlords are usually required to take care of any damages in a tenants home (unless the tenant was the one who caused the damage).

Also I'm a little confused as to the lady upstairs part. If the lady upstairs was using a washer that wasn't hers, then how was she using it? Not to mention why is she in an apartment that isn't hers in the first place.

I'm saying that because you might be able to sue that lady for damages as if she knew that the washer had a history of backing up. That would help pay to repair the damage to your apartment. But like rcarter said you should check to see what amount of time.

Now reviewing that the landlady hired a friend to fix the problem, you should show her the pictures and tell her to find a professional to fix the problem. She could have the friend take care of the mushrooms and that might solve your problem in the short term, but since those things grow at a fast rate; it might just be a termpary solution. Not to mention if she hired a friend to take care of the problem instead of a professional, she might know that something is up. But I'll take you at your word that she is a nice lady.

So... I'm in a hotel right now.

Things got even... creepier to say the least.  Remember the last set of pics I took?  Well, those caps quickly shriveled to where they look like the other thin strands, and it looks like that part is done and through with.

However....
A few hours ago, Jason came into the living room looking stunned.  I thought he had broken something, and he waved me to come over, telling me to hold my breath.  I did so nervously, and he opened our hallway closet.

Green... green and black and brown... everywhere. It's shocking, to say the least, because I guarantee it wasn't there even a week ago before the apartment flooded.  The closet hardly shares a wall with our bedroom either, meaning the mold must be through the whole ceiling.  I went into the bedroom and opened the storage closet, and glanced up.

Green, green, green.  Fuzz.  Mold.  Mildew.

I took pictures, but I forgot to bring my camera cord and I'm in the hotel right now.

Guys, I think I'm going to be forced into a move.  My husband is being casual still, saying we 'might' move in a 'few' months.  Agh. Help me.

Well mushrooms do grow quick in damp conditions.... and they probably started growing as there's probably a lot of moisture inbetween the floor above and the ceiling... 

your reactions are hilarious as you seem to be extremely concerned but yet you let them continue to grow.. seishiro gave the best advice... get some gloves and a mask and scrap/kill them and then disinfect the area so they cant grow through.. leaving them will only make it more work..

That is really intense. You must do your research so you can possibly sue the lady upstairs for causing the water damage (whoever owns the washer could be partially liable though) or sue your landlord for not taking the appropriate actions in a timely manner and leaving your health at risk.

My knowledge of law expands only to a business law course I took in college a couple semesters ago, but there is a legit opportunity to sue. You must also take the appropriate actions to let the landlord and lady upstairs know in a timely manner (ASAP) so that it cannot be used against you in a court of law. Check the maximum you can sue for in small claims court for your city/state and compare it to the total damages you would have to pay for damage. If any of your property bought by you or your husband is damaged beyond use/repair, get evidence of it and something to confirm it. Watch some Judge Judy to refresh your knowledge on small claims court.

You could also sue for pain and suffering if you develop a breathing problem or some other problem related to breathing in the mold. Also, you were forced to stay in a hotel because of the extent of the damage and spreading of mold, so those costs could also be potentially be sue-able regarding the cost to stay at a hotel due to the lack of timely action by the landlord and/or lack of responsibility by the lady upstairs. Be sure to use the words "not reasonable" when describing the wait time by the landlord and the lack of taking responsibility by the lady upstairs.

Also a major thing is the fact that the landlord could possibly not have a professional take care of it. Oldschool41 :  Sorry, I forgot to answer your question about the lady upstairs.  We live in a house that's split into three apartments, and the lady that rents the place above us is best friends with the landlady.  She went on vacation down to Gulf Shores with our landlady and told her son's long time girlfriend that she could use the washing machine.  I guess they all trust each other enough to let each other come in and out as they please, because the son's girlfriend had actually even left the door unlocked when the flooding occurred, which is how I was able to get in and shut the water off.  (I didn't try the door because I'd never think to do that, but the neighbor just opened it and walked right in.)

Well, Jason called the landlady this morning, and she sounded more irked than anything. Jason got off the phone rather quickly, and I was surprised.  I asked how the conversation went, and he said that our landlady just said she's going to call the friend.  I asked Jason why he didn't demand a professional, but he said that he's going to ask if the guy is licensed first.

Problem is, we don't really have the money to move.  This isn't like a typical apartment situation where we can just be moved into another unit. It's a house with three 'apartments', and the other two are occupied.  Jason did the calculations, weighed the options, and said he'd rather just stay in the apartment until early August, when we can have enough money saved up to move.

I finally got those pics uploaded.  Here is just SOME of the damage I found....  Realize that after I took these pictures, I took some stuff down and found even more. It's... everywhere.

This is what the mushrooms looked like when they were all done after a 24 hour life cycle.


This is super duper hard to see, but here is a white circle of mold growing in the ceiling paint.

Now, what's the plan?

Well.... my husband never did push for a professional.  The lady that opened the door to the flooded apartment upstairs came and took pictures.  She tried to downplay the whole thing because she's best friends with the land lady.  I -asked- my husband yesterday to make them take a look at my photos, since mine showed the severity of the issue.  He didn't, though.

Then, the guy who does work for the landlady came.  He scraped off the mushrooms and also tried to downplay it.  He even stated that the mold was no big deal, because there are mold in all houses, and that he was simply going to 'clean the mold up'.  When my husband asked for more to be done, the guy said that it wouldn't matter, because the paint would keep the mold from spreading.  -.-

Yes, I'm serious.  Furthermore, the guy said he can't come 'fix it' until Monday.

And of course, no offer was made to let us stay elsewhere.

I was at the park when this happened, because I don't want to be in the house.  My husband called me just to say that he was sorry, and that he couldn't get anything more.  He's sleeping in there again... not caring at all.

I don't want to be in the house.  So I'm not sure what I'm going to do.
Besides that, we don't have the money to move right now.

Life kinda sucks at this point.

Oh yeah, apparently my husband doesn't want to push for more, nor tell my landlady that we want to move, because he's afraid she will tell us to get out.  :/  Which is ridiculous. He doesn't care that I told him she can't legally do that, or doesn't care about any of the advice you guys gave me.

Find a lawyer that will do a free consultation and take the pictures to him and explain what was said and done. I don't know anything about law, but I'd imagine this kind of thing would be a slam dunk lawsuit.

Also, you said it wasn't a typical apartment, but do you still have a contract or a lease?
